Cookies

Our website may use cookies and similar technologies to improve your browsing experience and analyze website traffic. You may disable cookies through your browser settings.

Where cookies or similar technologies on this website are used for targeted advertising, or for purposes that constitute a sale of personal data under Texas law, you may opt out at any time by submitting a request as described under “How to Submit a Request” below. We also recognize universal opt-out mechanisms, including the Global Privacy Control (GPC) browser signal, and will treat a valid signal as a request to opt out of targeted advertising and the sale of personal data. Disabling cookies through your browser settings may not disable all tracking technologies.

Third-Party Services

We may use third-party providers such as Google Analytics, website hosting providers, email marketing platforms, and CRM software to help operate our business.

We may share the categories of personal data described above with the following categories of third parties: website hosting and infrastructure providers; analytics providers; Tatum Brown Custom Homes’ email and marketing platforms; customer relationship management providers; architects, designers, engineers, trade partners, and subcontractors engaged in connection with a client’s project; and professional advisors, insurers, sureties, and lenders. We may also disclose personal data where required by law or in response to lawful process, and in connection with a merger, acquisition, financing, or sale of assets. We require our service providers to process personal data only on our instructions and only for the purposes we specify.

Data Security

We implement reasonable administrative and technical safeguards to protect the information you submit. However, no method of electronic transmission or storage is completely secure.

Links to Other Websites

Our website may contain links to third-party websites. We are not responsible for the privacy practices or content of those websites. Please exercise caution with all third-party websites.

Children’s Privacy

Personal data collected from a known child under the age of 13 is treated as sensitive data under Texas law, and we process any such data only in accordance with the Children’s Online Privacy Protection Act. We do not knowingly process the personal data of a consumer we know to be between 13 and 17 years of age for purposes of targeted advertising or the sale of personal data. If you believe a child has provided personal data to us, please contact us using the information below and we will delete it.

Your Rights Under Texas Law

If you are a Texas resident, the TDPSA gives you the right to:

  • Confirm whether we are processing your personal data and access that data;
  • Correct inaccuracies in your personal data, taking into account the nature of the data and our purposes for processing it;
  • Delete personal data you provided to us or that we obtained about you;
  • Obtain a copy of your personal data in a portable and, to the extent technically feasible, readily usable format, where the processing is carried out by automated means; and
  • Opt out of the processing of your personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of a decision that produces a legal or similarly significant effect concerning you.

Residents of other states may have similar or additional rights under the laws of those states, and we will honor those rights to the extent they apply to us. Exercising any of these rights will not result in denial of goods or services, a different price, or a different level of quality.

How to Submit a Request

To exercise any of the rights described above, contact us at privacy@tatumbrown.com. Please identify the right you wish to exercise and provide information sufficient for us to verify that you are the consumer who is the subject of the request, or an authorized agent acting on that consumer’s behalf. We may decline to act on a request we cannot authenticate using commercially reasonable efforts, and we may request additional information for that purpose.

We will respond without undue delay and in any event within 45 days of receipt. We may extend that period once by an additional 45 days where reasonably necessary, in which case we will tell you of the extension and the reason for it within the initial 45-day period. We will respond free of charge up to twice in any 12-month period. If a request is manifestly unfounded, excessive, or repetitive, we may charge a reasonable fee or decline to act, and we will explain our reason for doing so.

Right to Appeal

If we decline to act on your request, we will notify you within 45 days of receipt and give the reason for our decision. You may appeal that decision within a reasonable period by contacting us at privacy@tatumbrown.com with the subject line “Privacy Request Appeal.” We will review the appeal and inform you in writing of our decision, with a written explanation of the reasons supporting it, within 60 days of receipt. If we deny the appeal, we will provide you a method by which you may submit a complaint to the Texas Attorney General at texasattorneygeneral.gov.

Data Retention

We retain personal data only as long as reasonably necessary for the purposes described in this Privacy Policy, including responding to your inquiry, performing and administering any agreement between us, and satisfying our legal, tax, insurance, accounting, warranty, and recordkeeping obligations. For personal data associated with a construction project, that period may extend through the applicable statutes of limitation and repose under Texas law. We then delete or de-identify the data.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the Effective Date at the top of this Privacy Policy and post the updated version on this website. If we make a material change to the categories of personal data we collect, the purposes for which we process it, or the categories of third parties with whom we share it, we will post notice of the change conspicuously on this website before the change takes effect. Your continued use of the website after the revised Effective Date constitutes your acknowledgment of the revised Privacy Policy.
